NEW YORK -- The International Civil Aviation Organization's Council declared Monday the Russian Federation violated international air law in the 2014 downing of Malaysia Airlines Flight MH17. This historic vote, occurring May 12, 2025, in Montréal, marked the first time the UN agency's dispute mechanism has rendered such a judgment on the merits between member states. Australia and the Netherlands initiated the case, asserting Russia's actions led to the tragedy that killed all 298 people aboard.


The ruling centered on Russia's breach of Article 3 of the Convention on International Civil Aviation, which mandates states "refrain from resorting to the use of weapons against civil aircraft in flight." Flight MH17 was destroyed by a surface-to-air missile over eastern Ukraine. The ICAO Council's decision followed extensive written submissions and oral hearings spanning multiple sessions, finding the claims well-founded in fact and law. Moscow has consistently denied any involvement in the air disaster.


Australian and Dutch officials welcomed the ICAO's determination, viewing it as a significant step toward establishing truth and achieving justice and accountability. They reiterated calls for Russia to accept responsibility for its conduct and make reparations. This international ruling follows a 2022 Dutch court conviction of two Russians and a pro-Moscow Ukrainian national for murder in absentia related to the incident. A formal ICAO document detailing the legal reasoning for its conclusions will be issued at a future meeting.
